Thank you for choosing Gather SD for your upcoming event. We are excited to host your special occasion and want to ensure a smooth and enjoyable experience for you and your guests. The following is our standard TERMS and CONDITIONS:
PAYMENTS
The Event Host may remit payment using one of the following methods:

by Zelle to info@GatherHereSD.com; registered as Harold Place LLC (Preferred Method)

through our website www.GatherHereSD.com (for $120 Booking Deposits only)

through 3rd party events platforms: TagVenue, Eventective, or PeerSpace
Full Payment is due 2 months before the event.
CANCELLATION
The Event Host may cancel the Agreement:
-
at any time up to 2 months before the Event Date by providing written notice of such election to gatherSD, at no cost to the Host.

within 2 months before the Event Date, the Host will be charged 50% of the Rental Costs paid and any expenses incurred in good faith by gatherSD in preparation for the Host’s use of the Venue.

within 1 month before the Event Date, the Host will be charged 100% of the Rental Costs paid and any expenses incurred in good faith by gatherSD in preparation for the Host’s use of the Venue.

at any time, due to unforeseen events, at no cost to the Host.
DEPOSIT POLICY

Reservation Deposit: A reservation deposit of $120 is required to secure a booking. This deposit is due at the signing of the contract and will be applied to the final invoice.

Damage Security Deposit: A refundable deposit of $250 is required and must be submitted 14 days before the event. The security deposit will be refunded within a week after the event, provided there is no damage or violations of the terms and conditions outlined in the rental agreement.

Alcohol Security Deposit: A refundable deposit of $150 is required and must be submitted 14 days before the event. The alcohol security deposit will be refunded within a week after the event, provided there is no excessive cleaning required; no property damage; no fees or fines incurred, etc. related to alcohol use.

Inspection and Walkthrough: An optional pre-event inspection will be conducted with the Event Host to document the existing condition of the venue. Any pre-existing damage will be noted and shared with the Event Host.
DAMAGES
The Event Host shall be responsible for all damages to gatherSD, its furnishings, fixtures, or any other property belonging to gatherSD, caused by the Host, their guests, vendors, or any third party associated with the event. In the event of damage, the cost of repair or replacement will be deducted from the security deposit. If damages exceed the amount of the security deposit, the client will be invoiced for the additional charges.
INDEMNIFICATION
The Event Host shall indemnify, defend and save harmless gatherSD, its officers, agents, and employees from and against any and all loss, cost (including attorneys' fees), damage, expense and liability (including statutory liability and liability under workers' compensation laws) in connection with claims, judgments, damages, penalties, fines, liabilities, losses, suits, administrative proceedings, arising out of any act or neglect by the Event Host, their agents, employees, contractors, Lessees, invitees, representatives, in, on or about the venue. This indemnity shall survive the termination of this Agreement. The Event Host hereby releases gatherSD from any and all liability or responsibility to the Event Host or anyone claiming through or under the Event Host by way of subrogation or otherwise for any loss or damage to equipment or property of the Event Host covered by any insurance then in force.
INSURANCE
The Event Host shall, at their own expense, obtain and maintain** throughout the term of this agreement, comprehensive general liability insurance coverage. The coverage shall be in amounts not less than $1M, with gatherSD listed as an additional insured. The Event Host could go to www.eventsured.com/gathersd/ to get a quote, which is usually less than $120 per event. ** optional but highly recommended particularly if Event Host will be serving alcohol.
EVENT TIMING AND OVERTIME CHARGES
The event is scheduled to begin and end at the agreed-upon time. Should the event extend beyond the scheduled end time, the Event Host agrees to pay overtime charges at a rate of $100 per hour or part thereof.
HOUSE RULES
Respectful Conduct: Please treat the venue and its staff with respect. All attendees are expected to behave in a courteous and considerate manner.
Caterers: Catering is allowed; however, please coordinate with our staff in advance to ensure a seamless setup and compliance with any regulations. Cleanup and removal of catering equipment are the responsibility of the event organizer. Cooking on site is NOT allowed
Alcohol Policy: If serving alcoholic beverages, please adhere to all local laws and regulations. Private parties by definition from California Alcoholic Beverage Commission, are exempt from license requirements.
Noise Levels: Be mindful of noise levels, especially during late hours, to respect neighboring businesses and residents. Please maintain the music and amplified sounds within the City allowable decibels (60dB).
Decorations: Feel free to decorate the space to suit your event. Ensure that all decorations are temporary and do not cause damage to the venue—no open flames, smoke machines, or anything that may pose a fire hazard.
Cleaning: Please leave the venue in the same condition as you found it. A cleaning fee of $75 per event is required even if all trash is disposed of properly. This is to cover Pre-Event and Post-Event thorough cleaning and sanitization. No visible trash, liquid spills, food mess, decorations, etc. should be left behind. Additional cleaning charges may be applied if the space is not returned to its original state.
Use of Building Dumpster: Dispose of only appropriate waste (event garbage in secured bags, non-hazardous materials). Do not overflow the dumpster. Do not leave items outside the dumpster or the trash enclosure. Oversized items such as decorations, props, etc. are not allowed. Violations of this policy may result in fines.
Capacity Limits: Adhere to the specified capacity limit of 75 guests, to ensure the safety and comfort of all attendees.
Parking: Ensure that guests do not park in reserved areas to avoid any inconvenience to neighbors or other businesses.
Smoking: Smoking is strictly prohibited inside the venue. Designate a smoking area outside, away from entrances.
Emergency Procedures: Familiarize yourself with emergency exits and procedures in case of any unexpected situations.

As part of our commitment to ensuring that your event goes smoothly, we offer the opportunity to do a walkthrough of the space using this checklist.

Parking Area:

We have 2 reserved parking spots next to the unit.

The whole parking lot in the middle is free for your quests.

DO NOT park in other places except in authorized parking spaces. Unauthorized parked cars may be towed at owner's expense.

DO NOT leave trash outside Unit 207

DO NOT congregate on the sidewalks or parking lot. Keep common areas clear.

DO NOT throw party decorations in the dumpster. Dumpster is only for garbage in secured trash bags.

Observe designated Smoking Area. Dispose cigarette butts in the provided receptacle.
Inside the Unit:

The key to enter is in the lockbox next to the door. We will send you the code for the day.

Bathroom lights and vents are on timer. Please reset every 2 hours using the timer next to the main entrance.

If you choose to use the Heater or AC, Roll-up door cannot be opened and will remain locked.
-
Please sweep any food mess and wipe liquid spills right away. Broom and mop are at the back of the plants.
-
Bathroom supplies refills are in the second basket in the bathroom.
-
Fire extinguisher is under the counter.
-
2 extra trash bag liners are on the trash cans.
-
Sink DOESN'T have a disposal. Please drain solids and throw in the trash.

Table and chairs will be set. DO NOT FOLD them after the event.

We have a microphone, speaker, smart TV, and projector if you need them. Bring your own device cable to connect to the projector (hdmi or usb)

Maintain music and amplified sounds within the City allowable decibels (70 dB). Use our decibel meter to measure sound levels from outside the Unit.

Our business cards for your guests are at the front desk.

• If you are planning a large party, inform your neighbors and the police in advance; include your phone number so
they may call you with any concerns. Have fun, be safe, and be a good neighbor!
Know How to Party Responsibly
• Underage drinking is associated with the leading causes of death for teens and young adults, including homicide,
suicide, and motor vehicle crashes.
• It is the duty of any person who hosts, permits, or allows a gathering to take steps to ensure that guests under the
age of 21 do not have access to alcohol.
You Must:
• Control access to alcoholic beverages at the gathering,
• Control the quantity of alcoholic beverages present at the gathering,
• Verify the age of persons attending the gathering by inspecting a driver's license or other government-issued
identification, and
• Supervise the activities of persons under 21 years of age.
You should also:
• Limit the number of guests. Keep it to people you know.
• Control the noise level. Take the party inside after 11 p.m.
• Plan for parking. Be sure that you and your guests are following local parking and traffic laws.
• Control your guests. If your party gets out of hand, ask people to leave.
• Alert the police if there are early signs that a party is getting out of control.
It Is Illegal to:
• Possess, consume, or purchase any alcoholic beverage if you are under the age of 21.
• Knowingly host, permit, or allow a gathering where at least one person under the age of 21 consumes an alcoholic
beverage.
• Sell alcohol without a license.
• Furnish alcohol to anyone under the age of 21.
• Operate radios, musical instruments, TVs, machines, loud speakers, or similar equipment in residential areas
between 11 p.m. and 8 a.m. that is plainly audible fifty (50) feet from the building or vehicle in which it is located.
Know What Can Happen
• If law enforcement officers determine that a party or event is in violation of laws, the following individuals may be held
responsible and face penalties:
• The person(s) who hosts, organizes or allows the event.
• The person(s) responsible for the residential or commercial property where the problem occurs.
• Violators can receive up to 6 months in jail and/or be fined up to $1,000 per incident.
• Repeated violations can result in additional fines and/or penalties.
• The police can also seize as evidence any device making the noise that violates the noise ordinance.
