Welcome to Gather SD! By booking and using our rehearsal space, you agree to comply with the following terms and conditions:
Booking and Payment:
Rehearsal slots must be booked in advance by calling (800) 820-0634 or by sending a message to info@gatherheresd.com. Your booking is confirmed once payment is received (through Zelle to info@gatherheresd.com; registered as Harold Place LLC). You will receive confirmation from us via email or other agreed-upon communication channels.
Usage Time:
Your booking grants you access to the rehearsal space for the agreed-upon duration only. Please arrive and depart promptly to avoid inconveniencing other renters.
Access Restrictions:
Your rental grants you access to the designated rehearsal space as agreed upon in the booking. Access to other areas of the facility (kitchenette and coworking space) may be restricted unless otherwise specified.
Equipment Usage:
Any equipment provided as part of the rental is to be used with care and returned in the same condition as received. Any damage caused to equipment during your rental period will be your responsibility to cover the costs of repair or replacement.
Health and Safety:
You are responsible for your own health and safety during your rental period. Prioritize safety during rehearsals by avoiding any risky or dangerous movements that could lead to injury. If you encounter any hazards or maintenance issues, please inform staff immediately.
Damages:
The Renter shall be responsible for all damages to gatherSD, its furnishings, fixtures, or any other property belonging to gatherSD, caused by the Renter. In the event of damage, the Renter will be invoiced for the cost of repair or replacement.
Liability Waiver:
By booking and using our rehearsal space, you acknowledge and accept the inherent risks associated with using a shared facility. Gather SD and its affiliates are not liable for any accidents, injuries, or illnesses that may occur during your rental period.
Indemnification:
The Renter shall indemnify, defend and save harmless gatherSD, its officers, agents, and employees from and against any and all loss, cost (including attorneys' fees), damage, expense and liability (including statutory liability and liability under workers' compensation laws) in connection with claims, judgments, damages, penalties, fines, liabilities, losses, suits, administrative proceedings, arising out of any act or neglect by the Renter, their agents, employees, contractors, Lessees, invitees, representatives, in, on or about the venue. This indemnity shall survive the termination of this Agreement. The Renter hereby releases gatherSD from any and all liability or responsibility to the Renter or anyone claiming through or under the Renter by way of subrogation or otherwise for any loss or damage to equipment or property of the Renter covered by any insurance then in force.
Termination of Rental:
We reserve the right to terminate your rental and require you to leave the premises immediately if you fail to comply with these terms and conditions or engage in behavior deemed disruptive or inappropriate.
Changes to Terms:
Gather SD reserves the right to amend these terms and conditions at any time. Any changes will be communicated to you via email or other agreed-upon communication channels.
Refund Policy:
Rental fees are non-refundable unless the rehearsal space is unable to be provided as agreed upon due to unforeseen circumstances.
By booking and using our rehearsal space, you indicate your understanding and acceptance of these terms and conditions. Enjoy your rehearsal at Gather SD!
HOUSE RULES
To ensure a positive experience for all users and maintain a safe and respectful environment, we kindly ask you to adhere to the following house rules:
1. Respect the Space and Fellow Renters: Treat the rehearsal space with care and respect. Please refrain from any behavior that may disrupt others or cause damage to the premises or equipment. Renter will assume full responsibility for damage to the facilities, and the theft of any property on the premises.
2. Noise Level: While we encourage creative expression, please be mindful of noise levels to avoid disturbing neighboring studios or businesses. Use of amplified music should be kept at a reasonable volume. Loud, boisterous noises, profanity, or other offensive behavior is not allowed.
3. Cleanliness: Clean up after yourself. Leave the space in the same condition as you found it. Dispose of any trash or belongings properly, and wipe down any equipment or surfaces used during your rehearsal. No food or beverages are allowed, except water in closed containers.
4. Footwear Policy: For the protection of our floors, tap dancers must use portable tap dance flooring when wearing tap shoes.
5. Personal Belongings: Store personal belongings in designated areas and ensure they do not obstruct walkways or common areas. GatherSD will not be responsible for any articles, personal or otherwise, which are lost, stolen, or missed by any renter or guest.
6. Guests and Visitors: Prior authorization is required for any guests or visitors accompanying participants during rehearsals. All guests must comply with studio rules and regulations.
7. Emergency Procedures: Familiarize yourself with emergency exits and procedures in case of fire or other emergencies. In the event of an emergency, follow instructions from staff and evacuate the premises calmly and safely.
8. Feedback and Suggestions: We value your feedback and welcome any suggestions for improving our services. Please don't hesitate to share your thoughts with us.
By utilizing our rehearsal space, you agree to abide by these house rules. Failure to comply may result in the suspension of rental privileges.
